These General Terms and Conditions are in addition to any Contract, Warranty, Plan or Manual ECOGENCIA has with a customer including contractors, representatives or third parties.
ECOGENICA has estimated the energy performance calculations and provided these with your Proposal. Our standard calculations are based on standard calculations approved for use by the Microgeneration Certification Scheme (or any equivalent approved by HIES). Where ECOGENICA has referred to energy inflation or other statistical information, we have used information publicly available from the Office for National Statistics. The estimates provided are a guide only and must not be considered as a guarantee of performance.
When you place an enquiry with ECOGENICA via our website, clarification of the following may be required of the:
From time to time, the delivery of Goods will be outside the pre-arranged time, due to issues beyond the control of ECOGENCIA. Under these circumstances, ECOGENCIA will negotiate as revised delivery date.
It is your responsibility for notifying ECOGENICA of any restrictions at the point of delivery such as, more than 50 meters of foot travel, local parking restrictions, stairs, climbs.
It is your responsibility to ensure someone is present at the property when the Goods are to be delivered.
Once the Goods are delivered you take responsible for any damage.
ECOGENICA reserves the right to request an inspection or for pictures to be forward for inspection. This process will enable any issues of access or otherwise before delivery and installation can be addressed.
In providing pictures, in whatever form, you are responsible to ensure their accuracy of what a technical specialist will see at your property.
If, upon physical inspection of the site, and it is not possible to install the unit, ECOGENICA will inform you of why the installation cannot proceed due to factors outside your control. ECOGENICA will refund in full and remove the unit.
However, if the issue arises as a result of incorrect, incomplete or misleading photos or information which you have provided, you will not receive a refund of any monies paid and you will be responsible for any costs involved removing the unsuitable Goods and (if requested by you) reproducing and redelivering alternative Goods.
Where a delivery or installation is impeded by something within your control (e.g. contaminated area or removal of contamination), ECOGENICA will be entitled to retain reasonable costs including delivery costs and deposit. You will be refunded for the remaining funds. Such an arrangement will be undertaken in conjunction with any contract between the Parties.
Where a suitable location for the external Heat Pump Unit cannot be identified, ECOGENICA reserves the right to cancel the order and will refund any money you have already paid.
Where the site is determined to require works to ensure the safe installation of the heat pump unit, ECOGENCIA will provide an estimated cost of the works, before commencing. If the extra work is declined, you are entitled to a full refund.
All installations are undertaken by a suitably qualified installer, and in accordance with any national laws, standards and ECOGENICA specifications.
We will prepare an Installation Plan for you, which will set out the specific requirements for your installation.

No installation is the same, and ECOGENICA may notify you of any additional requirements for your installation.
All installers, representatives and contractors of ECOGENICA always treat you courteously and expect you to treat them in a similarly respectful way.
ECOGENICA take seriously any threatening, abusive or violent behaviour against any of our engineers. Where an incident of threatening, abusive or violent behaviour towards our engineers occurs, the engineer will immediately leave your home, and the incident may be reported to the police.
ECOGENICA will not send another installers, representatives or contractor to your home until an investigation has been finalised.
ECOGENICA reserves the right to terminate any agreement or arrangements with you at any time, where the above behaviour has been proved.
You must provide adequate parking within 20 meters of the residence or other building location of where the heat pump is to be installed and ensure a parking permit is available.
You are also responsible to secure any permissions, licences or permits that may be required to authorise the installation, a landlord, freeholder agreement, buildings regulations approvals, and local authority approvals and party wall act agreements.
Existing electrical systems and other equipment must all be in safe working order.
All electrical cables and pipework will be installed in a safe manner and according to any legal or industry standards, this includes the routing of electrical cables and pipework.
For health and safety reason any representative, contractors or third party engaged on behalf of ECOGENICA will work within the prescribed legal working hours and where possible only during daylight hours.
From time to time, damage to the property may occur as part of the installation of a heat pump. Where any damage has been incurred, ECOGENICA will not be liable to make good such damage.
ECOGENICA will not be liable for any damage to your home which is caused as a direct result of structural defects or weaknesses at your property (whether they are visible or not).
The representative, contractors or third party may take pictures of your installed heat pump and relevant infrastructure for our auditing process and for our own records.
All representative, contractors or third party will be subject to the Health and Safety Laws of the United Kingdom.
ECOGENICA will remove waste from your property not more than 7 days following completion of the installation, subject to the payment of an additional charge.
ECOGENICA will not be responsible for removing any waste which is not produced as a direct consequence of our performance of the Services or delivery of the Goods, that is hazardous (including but not limited to asbestos) or which otherwise comes from your home or garden.
ECOGENICA is not liable for any loss of profit, loss of business, business interruption or business opportunity under any circumstances.
You are responsible for risk of damage or loss to the Goods from the date that we deliver the Goods to your home.
It is your responsibility to have relevant insurance.

For any disputes, refer to the dispute resolution section of your contract or other agreement that you have with ECOGENICA.
In the event of ECOGENICA may transfer our rights and obligations to a suitably qualified third party of our choosing.
You may not transfer your rights and obligations without the consent of ECOGENCIA.
